Sierra on the Tolkien license

I was thinking about the big announcement Sierra made about getting the license and showing footage at E3 and such when it hit me, Sierra already had the Tolkien license. Was the license taken away and they negotiated to get it back? I asked Sierra what happened to the Tolkien license which they had before the big lawsuit with Tolkien Enterprises. Here's what they had to say:

"We have been in negotiations with Tolkien Enterprises to clarify and amend the agreement we signed several years ago."
